Liners : Please be advised that this law office has been retained by Partners Equity Capital Company LLC, Assignee of Commerce Commercial Leasing LLC, ("PECC'), for purposes of collecting the outstanding balance due and owing on Lease No . 102412 ("Lease") dated April 29, 2005 . Our client's records indicate that the Lease and Personal Guaranty are in default by reason of Lessee and Guarantor's failure to make the payments due under the Lease as they became due . As a result of Lessee and Guarantor's failure to make payment under the Lease and respond to the previous requests for payment from our client, all amounts due and owing on the Lease are accelerated in accordance with the terms of the Lease and Guaranty . Accordingly, demand is hereby made upon Lessee and Guarantor for payment in the total amount of $135,653 .03, plus additional attorney's fees, legal costs and expenses as they accrue . Failure to make payment as demanded will leave us with no alternative other than to immediately commence a legal proceeding against Lessee and Personal Guarantor for the full accelerated balance due and owing, together with any and all charges associated with the litigation as described above . Any discussions or negotiations by PECC, Lessee, Guarantor, their respective attorney, and any other panty concerning a Forbearance Agreement or the possible amendment, reinstatement, waiver or other modification of the Lease, and/or the acceptance of any partial payments from you or any third party shall not : (i) constitute an agreement by PECC to forbear from exercising any of its rights or remedies, or to enter into any amendment, reinstatement, waiver or other modification of the Lease; (ii) waive any existing default or event of default; (iii) establish a course of dealing or conduct ; or (iv) waive, limit, modify or prejudice any of PECC's rights and remedies, all of which are hereby expressly reserved.
